This session will consider a proposed set of guiding principles for the prevention, management and resolution of investor-State disputes. Drawing on the discussions and lessons emerging from the Roundtable, the Principles will identify key approaches that can assist States in anticipating, managing and responding to dispute risks before they escalate into formal proceedings. Delegates will share perspectives from their respective jurisdictions with a view to refining and agreeing on a common set of Principles to guide investor-State dispute risk and crisis management across Africa. The session will also consider a complementary Framework designed to support implementation of the Principles. The Framework is intended as a voluntary, non-binding reference document to guide policy development, institutional strengthening, capacity building, and country-level engagement on investor-State dispute governance, prevention and preparedness. Together, the Principles and Framework aim to provide States with a practical African reference point for strengthening their approach to investor-State dispute management.
