Participants will engage in a simulated dispute involving a US$250 million mining investment
confronted by competing decisions of State institutions, a newly introduced strategic minerals
regime requiring licence revalidation and State participation, mounting community protests,
and the prospect of international arbitration within 90 days under an applicable bilateral
investment treaty.
The simulation will be facilitated through presentations of the positions and competing
considerations of the key governmental actors involved, namely the Cabinet, the Ministry of
Mines, and the regulator established under the strategic minerals framework. Delegates will
analyse the underlying causes of the dispute, assess whether alternative decisions or
interventions could have mitigated the risk of conflict, and consider practical strategies for
resolving or managing the dispute before it progresses to arbitration.
