Many African states are concerned that the reforms risk sidelining the issues that matter most to countries seeking a more development-oriented investment framework, and if their core concerns are removed on procedural grounds, the legitimacy of the entire reform process is at stake. Some states have moved away from ISDS domestically, while SADC has stripped it from its investment protocol, but there’s no continental consensus yet. This session explores these concerns and how they are being articulated/implemented what is the way forward.
